4.5 529 Plans
New Bankruptcy Act 11 U.S.C. § 541 excludes 529 plans and education IRAs from the bankruptcy estate. Certain limits apply. The Maryland statute establishing529 plans states: “A person may not attach, execute, garnish, or otherwise seize any current or future benefit under an investment account or any asset of the Plan.” Education § 18-19A-06.1 “Person” does not include the State.
